A, 2020 graduate of O.P. Jindal Global University with a B.B.A., LL.B. (Hons.) degree. He decided to write this article while been taught the subject of ‘Professional Ethics’ by Mr. WasiqAbass Dar, one of the prominent professors of O.P. Jindal University. This article tries to touch upon one among many inconsistencies that exist in our legal society and suggest some ways for the new rules to be brought forward without contradicting the fundamental principles of the legal system. You may already know or get to know after reading this article that Bar Council Rules in India stands absolutely against the advocates for publicising their services. And many lawyers have been prosecuted under the provision of ‘The Advocates Act, 1961’ for contravening the rule.The clause 36 of Section IV (‘Duty to Collegues’) of the ‘Standards of Professional Conduct and Etiquette to be observed by Advocates’ laid down a humongous wall around the legal profession limiting and restricting the lawyers to enjoy the mere basic rights attached with the simple term ‘profession’. The idea behind the article was to draw the attention towards the problem and import, if any, rules that have been followed by other countries like United Kingdom, Singapore, United States, Australia, European Union, etc. to overcome the problem in our system. He is a law student but soon he will be governed by the same Advocates Act, 1961, like the remaining two million advocates in India. While he is delighted to be a future part of the system but rules like this clearly cast a certain amount of shadow over his excitement.
