Q. A woman is treated for infertility by a doctor claiming to be a specialist in
`reproductive medicine' and 'infertility'. The husband of the patient is
diagnosed to be azoospermia (no sperms in the semen). The woman's maternal
passage, on examination, and investigations is found normal. Her menstrual cycle
also is found to be normal. Artificial insemination is done with the consent of
the couple. The woman conceives. The pregnancy is confirmed by tests. The family
is jubilant. Their relatives and acquaintances believe it to be `normal'
pregnancy consequent to successful treatment of infertility. The husband is
congratulated. Traditional community and social functions are held.
One day, a young man walks into their house. The woman remembers to have seen
him in the doctor's clinic. The gentleman tells the lady that the semen used for
artificial insemination in her case is his, and that he is the father of the
child in her womb. He threatens to disclose the fact unless she does what he
desires, and obeys his commands, and starts blackmailing the woman.
Dilemma And Issues What should the woman do ?
What advice, would you give the woman for dealing with the man who is
blackmailing her, and to get out of the mess she has got into, without getting
exposed to public ridicule, censure and stigma.
Technically, it is adultery. What will happen if the husband denies having
consented to artificial insemination? Worse still, what will be the consequences
if the doctor denies having done artificial insemination?
Whose responsibility is it to ensure availability of the sensitive and
technically highly complex health care facilities and their operation according
to laws scientific norms?
Who will ensure scientific and legal norms of (a) donor selection (phenotyping
bodily resemblance to recipient parents, (b) recipient's blood group, etc and
screening ( for transmittable genetic diseases, sexually transmittable diseases,
etc.) in practice of artificial insemination - a mode of assisted reproduction ?
Who will ensure that the doctor claiming to be a specialist in infertility does
possess the competence and facilities to meet the norms?
How do the road-side, aggressively advertising, infertility clinics maintain the
confidentiality and anonymity of patients and the donors?
Should such facilities be permitted as free-market enterprises, or should they
be facilities provided, regulated, rationed and subsidized by the State, as a
part of the family welfare programme ?
Should not the Medical Council of India and the State Medical Councils be held
liable for not doing their constitutional duty of ensuring that the doctors they
license to practice, observe prescribed health care norms and standards?
Response:
This is a deeply complex and sensitive situation, touching on ethical, legal, and personal dimensions.
Here are some critical points to consider:
-
Immediate Safety and Legal Action:
The woman should prioritize her safety and seek legal advice immediately. Blackmail is a serious crime, and she should report the man to the authorities. Legal professionals can guide her on how to handle the situation without exposing her to public ridicule.
-
Medical and Ethical Responsibility:
The doctor has a duty to ensure that all procedures are conducted ethically and with full transparency. If the doctor denies performing the artificial insemination, it could lead to legal complications. The woman should gather all medical records and consent forms to support her case.
-
Consent and Adultery:
If the husband denies having consented to the artificial insemination, it could complicate matters further. However, the focus should remain on the fact that the procedure was medically necessary and consensual at the time. Legal counsel can help navigate these complexities.
-
Regulation and Standards:
The responsibility for ensuring the availability of sensitive and technically complex healthcare facilities lies with both the medical institutions and regulatory bodies. The Medical Council of India and State Medical Councils should enforce strict guidelines to ensure that only qualified professionals perform such procedures.
-
Confidentiality and Anonymity:
Infertility clinics must maintain strict confidentiality and anonymity for both patients and donors. This is crucial to protect the privacy and dignity of all parties involved. Regulatory bodies should monitor and enforce these standards.
-
Free-Market vs. State-Regulated Facilities:
There is a strong argument for such facilities to be regulated and subsidized by the state to ensure equitable access and adherence to high standards. However, a balance must be struck to allow innovation and competition within the sector.
-
Accountability of Medical Councils:
The Medical Council of India and State Medical Councils should be held accountable for ensuring that licensed doctors adhere to prescribed healthcare norms and standards. This includes regular audits and strict penalties for non-compliance.
Ultimately, this situation underscores the need for robust legal and ethical
frameworks to protect individuals undergoing assisted reproductive procedures.
The woman should seek professional legal and medical advice to navigate this
challenging situation
Q. The options of reporting to the police, seeking legal help, reporting to the
regulatory bodies etc were not acceptable to the couple. As it was a small town
they were afraid of exposure and social stigma. They had given out to the public
that it was normal pregnancy after the treatment of infertility. They were not
in a position to leave the town and go away. Finally, they responded to some
wiseman's counsel. Next time the black mailer came to her house that she would
shout and report to the police that he raped her. She told him that he should
leave the town or else when she next encounters him in public she would do the
same thing in public. The bold and aggressive stance of the hitherto meek and
submissive lady put the fear of life in him. The crook disappeared, I learnt.
Your comments?
Response: Wow, what a turn of events! The woman's bold and assertive
stance in the face of such a difficult situation is truly commendable. It's a
powerful reminder of the strength and resilience people can find within
themselves when pushed to their limits.
While her approach was unconventional and risky, it ultimately worked in her
favour. However, it's important to note that such situations can be extremely
dangerous, and seeking professional help is usually the safest route. The fear
of social stigma and exposure is a significant barrier, especially in smaller
communities, but the safety and well-being of the individual should always come
first.
This story also highlights the need for better support systems and protections
for individuals undergoing assisted reproductive procedures. Confidentiality,
ethical practices, and robust legal frameworks are essential to prevent such
situations from arising in the first place.
What a story! It's a testament to human courage and the complexities of
navigating societal pressures
