and devotion.
In colloquial language, "property" pertains to an individual's possession of an
object (or items), including a mobile phone, book, or vehicle, as well as the
owner's association with said item. The concept is subject to a more nuanced
legal interpretation. Significant factors to consider include the object's
characteristics, the relationship between an individual and the object, the
interaction among multiple individuals and the object, and the object's standing
within the present political system. Property most succinctly and broadly refers
to an individual's ownership rights or rights to particular items or objects in
the legal context.
Property rights are fundamental concepts that provide the basis for the
functioning of civilizations throughout. Property rights encompass the lawful
privileges to own, employ, regulate, and shift ownership of property,
encompassing tangible assets such as land and goods, as well as intangible
assets such as intellectual property. The presence of basic rights is crucial
for the promotion of economic progress, social stability, and individual
freedom.
Property rights violations occur when these rights are infringed upon, either
via illegal activities or acts of negligence. These violations can appear in
several forms, including actions such as theft, trespassing, vandalism, and
infringement on intellectual property. The compromising of ownership integrity
can lead to disruptions in economic operations and perhaps result in social
turmoil.
The need of enacting suitable measures to safeguard property rights cannot be
overstated. Insufficient methods for resolving infringements on property rights
can lead
to lasting damage for both persons and companies, resulting in financial
setbacks and a decline in faith in the court system. Effective remedies ensure
that offenders are held accountable, deter future violations, and restore the
rights and dignity of victims. The objective of this study is to examine the
concept of property rights in society, examine common occurrences of
infringement, and assess the importance of implementing effective methods to
protect these rights. The purpose of this undertaking is to shed light on the
crucial importance of property rights in promoting fairness, prosperity, and
stability within global communities.
Right To Property As A Constitutional Right
The concept of the right to property may be seen as a fundamental human right in
some respects. The matter at hand is very controversial and has implications for
several nations, including the European Union. The first recognition of the
right to property as a basic right in India was subsequently diminished to a
constitutional right by the 44th amendment of the Indian Constitution, namely
through the inclusion of Article 300(A). The right to property under the Indian
Constitution has a distinctive historical background characterised by a
prolonged clash of provisions between India's legislature and the court, despite
its seeming simplicity.
The present study investigates the historical trajectory of the constitutional
right to property within the framework of the Indian Constitution. It explores
the evolution of this right, starting with its establishment as a fundamental
right in 1950, followed by its removal as a basic right, and ultimately its
restoration as a constitutional right in 1978. The Fundamental Right to Property
has the notable distinction of being the second most controversial clause during
the framing of the Constitution, as well as the most often modified or revised
provision. Furthermore, it stands out as the only fundamental right that was
abolished in 1978.
According to Section 2(c) of the Benami Transactions (Prohibition) Act, 1988,
the word "property" is defined as follows: The term "property" encompasses all
types of assets, regardless of their nature (movable or immovable, physical or
intangible), and includes any entitlement or stake in such assets. According to
Section 2 (11) of the Sale of Products Act of 1930, the concept of property is
defined as follows: The term "property" refers to the whole ownership of things,
rather than simply a specific item.
In the case of Commr. Hindu Religious Endowment v. Swamiyar(1954), the Supreme
Court said that the word "property" used in Article 31 should be interpreted
broadly, including all recognised types of interests that possess the
distinctive features or attributes of a property right. The case of
Dwaraka Das
Srinivas v. Sholapur Spg and Wvg. Co. Ltd (1958) demonstrates that it embraces
both corporeal and incorporeal rights. It includes monetary assets, contractual
agreements, property rights such as the interest of an allottee, licensees,
mortgages, and property lessees.
The Commissioner of Hindu case (Supra) has recognised the identifiable interest in the property as the Mahantship of a
Hindu Temple, whereas the
State of Bihar v. Kameshwar Singh (1952) case has
established the interest of shareholders with interests in the Company. In the
case of
State of Kerala v. Padmanabhan Nair (1985), it was established that the
entitlement to a pension is considered a kind of property.
Understanding Property Rights
The Constitution (First Amendment) Act of 1951 included the Ninth Schedule to
the constitution, together with two supplementary Articles 31A and 31B, with the
aim of rendering measures conferring legal authority onto zamindars immune from
judicial scrutiny.
The Fourth Amendment Act of 1955 brought about many modifications to Article 31,
which pertains to the right to property. The objective of these modifications
was to provide the government more authority in the process of forcibly
acquiring and requisitioning private property. The compensation sum awarded for
this reason was deemed unreasonable in order to mitigate the impact of the
Supreme Court's verdict in State of West Bengal v. Bella Banerjee (1954). After
gaining independence, there was a desire to uphold Prime Minister Jawahar Lal
Nehru's socialist objectives and eliminate zamindars and other rural middlemen
who had acquired extensive land rights under colonial rule. When the government
tried to destroy these institutions, it faced
legal objections under the Right to Property clause of the Constitution in a
sequence of legal disputes. Consequently, the government opted to avoid legal
disputes while implementing its socialist ideals of restricted private land
ownership in order to prevent the accumulation of wealth and government control
over the property, with the aim of ensuring widespread development.
The criticism of Articles 19(1)(f) and 31 of the Constitution as Fundamental

and benefit from the products or services. Owners of private property are
permitted to exchange the resource voluntarily.

property from its proprietor. The valuation of the property for each party
involved determines its exchange price.
