Now after the Jinah controversy Aligarh Muslim University is again in
publicity. Because of the violation of right of SC, ST& OBC I am in the
favour of SC, ST & OBC reservation policy in Aligarh Muslim. In the defence
AMU administration argues that Minority institutions are a exemption from any
type of reservation under the Article 30 of Indian Constitution. In this we will
analysis that whether the Aligarh Muslim university is a minority institution
or not ? If not than why ?

If we look back in the history of Aligarh Muslim University than we will
find that Mohamaddan Anglo oriental college was established by the Sir Syed
Ahmed Khan in 1875 at Aligarh district of Uttar Pradesh which was replaced by
the status of University named as Aligarh Muslim university through the British
Parliament Act 1920.

It is not any doubt that Sir Syed Ahmed Khan was the founder of MAO
college butAligarh Muslim university was establishedby the Parliament Act
1920.

So It can not be claimed the status of Minority Institution For the
minority vote purpose Indira gandhi passed the AMU Act 1981 for the beneficial
for AMU but in
Azeez Basha v/s Union of India case Supreme Court declared AMU Act 1981 as
unconstitutional and held that Aligarh Muslim University was not a minority
institution because it was established by the British parliament Act 1920 and
now days this case was pending in Supreme Court and Supreme Court Did not
stayed the decree of Allahabad high court somy fundamentalist friend you can
denied the right of SC ST and OBC because Aligarh Muslim university is not a
minority I situation.
