In a recent development, the Delhi High Court dropped the defamation suit
that Trinamool Congress MP Mahua Moitra had brought against BJP MP Nishikant
Dubey and attorney Jai Anant Dehadrai for their social media statements after
the defendants removed their posts.
Lawsuit Facts:
- The lawsuit began in 2023 when Mahua Moitra, a TMC MP, sued Dubey and Dehadrai for defamation, claiming that the defendants had falsely claimed that she had accepted money for asking questions in Parliament.
- In addition, the MP requested that the two defendants and certain media outlets refrain from making such defamatory remarks and be instructed to apologize publicly to the MP in a variety of newspapers and languages.
- Additionally, the plaintiff requested that the court issue an ex-parte injunction to remove these defamatory publications, photographs, videos, and posts from all platforms until the matter was settled.
- Regarding the controversy, it began when Dubey accused Mahua Moitra of accepting money for posing questions in the Parliament in a complaint to the Speaker of the Lok Sabha. Based on the facts he obtained from a letter from Dehadrai, Dubey made the assertions.
- Moitra filed an application against a remark tweeted by Dehadrai that described the allegations as "bombshell development in the Lokpal case filed by Dr. Nishikant Dubey MP" in order to refute the assertions in the complaint against her. Furthermore, Dubey stated on Facebook that Moitra's suspected overseas accounts and expenses were the subject of a case filed by the CBI.
- The attorney representing Dubey contended that his post was a response to Moitra's remark in which she used the phrase "pitbull," which his client deemed disparaging. Additionally, it was asked that Moitra refrain from mentioning such things.
- In response to the aforementioned allegation, Moitra's attorney claimed that the defendant was both directly addressed and tagged in the plaintiff's posts, and that the phrase "pitbull" was not meant for the defendant.
Court Ruling:
- The Delhi High Court declared that the plaintiff's statement was recorded and that she was obligated to abide by it.
- The Court asserted that no additional guidance was required because Moitra had explicitly denied any intention to call Dubey "pitbull."
- The defense attorney informed the court that the purported Facebook post had been removed, and Justice Manmeet Pritam Singh Arora dismissed the case. Dehadrai also promised the court that he would remove the post he posted on social media site X.
- Since defendant No. 1 has already taken down the other post from Facebook and defendant No. 2 has promised to take down the contested post from 'X,' the remedy requested in this complaint is not viable. The Delhi High Court declared, "The application is hereby disposed of."
- The next hearing in this lawsuit is scheduled for July 17, 2025.
