Why We Need a National Men's Commission: Mukesh Kumar Singh v/s Union of India

The Public Interest Litigation (PIL) filed for the creation of a National Men's Commission is an intriguing case that raises questions about gender equality and the need for a formal platform to address men's issues in India. This case commentary will discuss the key issues raised, the court's analysis, and the implications of establishing a National Men's Commission.

Background:
The PIL seeks the establishment of a National Men's Commission on the grounds that there is a need to address various social and legal issues faced by men in society. The petitioner contends that men also face discrimination in areas such as child custody, domestic violence, false dowry harassment cases, and mental health issues, among others. It argues that a specialized body is needed to advocate for men's rights and welfare in the same way that the National Commission for Women serves women's interests.

Key Issues:

  • Gender Equality: The case raises the issue of gender equality and whether the creation of a specific commission for men is necessary, considering existing structures like the National Commission for Women.
  • Specific Concerns: The PIL highlights key concerns faced by men, including child custody battles, domestic violence, and false accusations in dowry harassment cases, questioning whether there should be dedicated support mechanisms to address these issues.

Court's Analysis and Decision:

The court's analysis and decision in this case will depend on various factors, including the current legal framework, societal context, and constitutional principles. While the court may recognize that men face challenges and issues, it needs to evaluate whether establishing a separate commission is the most appropriate course of action. The court is likely to consider the following factors:
  • Constitutional obligation of gender equality: The court may examine the constitutional provisions and past judgments to assess whether they necessitate the creation of a National Men's Commission to ensure gender equality.
  • Existing mechanisms: The court may assess whether the current frameworks, such as family courts, police stations, and NGOs, adequately address the concerns raised in the PIL or if they require modification or improvement.
  • Consideration of women's rights: The court may deliberate on the potential impact of establishing a National Men's Commission on women's rights and whether it may inadvertently undermine the gains made in women's empowerment and gender justice.

Implications:

  • Men's Rights Advocacy: The commission could serve as a platform for amplifying men's issues and concerns, facilitating policy discussions, and advocating for equitable legislation.
  • Gender Balance: A National Men's Commission, if created, may contribute to a more balanced approach to gender issues by recognizing the significance of addressing men's concerns alongside women's.
  • Social Dialogue: It could foster public discussions about gender, challenging existing stereotypes and promoting a deeper understanding of various gender-related challenges.
  • Allocation of Resources: A National Men's Commission may influence resource allocation by advocating for government funding for men's welfare programs, research, and support services.

Conclusion:
The PIL for a National Men's Commission raises significant questions regarding gender equality and the need for dedicated platforms to address men's issues. The court's analysis and decision will play a crucial role in determining how these concerns are addressed within the constitutional framework. It is essential that any decision promotes equality and fairness for all genders while avoiding the potential marginalization of women's rights and interests.

My view point:
Although in the history of mankind we always see that women's have to suffer a lot in this male dominating society. Due to which our legislature has enacted those laws which protect their rights after a period they started to misuse them and now a situation came when we need to talk about the right of men.

As we all know that we live in a democratic country where everyone's right is protected irrespective of religion ,race, caste , sex and place of birth and when someone's right is infringed then through suitable legislation our government have to protect it.

Hence, the apex court need to pass order for approval of National men's commission.
