Confession - A confession no doubt can be used as corroborative material but inn the face of the infirmities in the prosecution case ,implicit reliance can not be placed to hold that the prosecution case stabs proved by the appellants confession.

when the appellants had voluntarily made the confessional statements and admitted that the contraband was seized from her possession, appellants conviction and sentence therefore confirmed.

The Social Judge solely relied on the Confessional statement of the co accused which is not at all a legal or substantive evidence as against the petitioner, for framing the charge he has thus committed an illegality in relying on an inadmissible evidence against the petitioner. Hence ,the charge framed against the accused petitioner for the offence under section 29,21 and 22 of the Act can not be sustained.

If confessional statement of accused is voluntarily and recorded without threat or incumbent ,such confession is admissible in evidence.
