Receivers Right

In the interest of justice and fairplay a serving Judicial Officer should not be appointed as a receiver by any Court of Law. Sub Rule (2) clearly indicates that Court and it's Officer ,the Receiver,does not possess any right higher than the right a party to the suit possess. Receivership can't not be imposed on the parties by the court. The court appointed Receiver of the mortgaged property in dispute. Receiver having taken vacant possession of the property can not induct tenant in the property without the permission of the Court. AIR 1993 Bom 265
