Principles summarised regarding relevancy of stage of the proceedings addition or alterations of charges u/s 216 Crpc

The court is empowered to alter or add charges even after the completion of evidence, argument s and reserving of the judgement,the test to be applied by the court while deciding upon an addition or alteration of charge is that the material brought on record needs to have a direct link or Nexus with the ingredients of the alleged offences, further, the court while altering or adding charges, must exercise its power judiciously and ensure that no prejudice is caused to the accused and that he is allowed to have a fair trial.
