Procedure To Obtain Indian Citizenship

Sec 5. Citizenship by registration:

  1. Subject to the provisions of this section and such other conditions and restrictions as may be prescribed, the Central Government may, on an application made in this behalf, register as a citizen of India any person not being an illegal migrant who is not already such citizen by virtue of the Constitution or of any other provision of this Act if he belongs to any of the following categories, namely:
    1. a person of Indian origin who is ordinarily resident in India for seven years before making an application for registration;
    2. a person of Indian origin who is ordinarily resident in any country or place outside undivided India;
    3. a person who is married to a citizen of India and is ordinarily resident in India for seven years before making an application for registration;
    4. minor children of persons who are citizens of India;
    5. a person of full age and capacity whose parents are registered as citizens of India under clause (a) of this sub-section or sub-section (1) of section 6;
    6. a person of full age and capacity who, or either of his parents, was earlier citizen of independent India, and [is ordinarily resident in India for twelve months] immediately before making an application for registration;
    7. a person of full age and capacity who has been registered as an [Overseas Citizen of India Cardholder] for five years, and who [is ordinarily resident in India for twelve months] before making an application for registration.

Explanation 1:
For the purposes of clauses (a) and (c), an applicant shall be deemed to be ordinarily resident in India if:
  1. he has resided in India throughout the period of twelve months immediately before making an application for registration; and
  2. he has resided in India during the eight years immediately preceding the said period of twelve months for a period of not less than six years.

Explanation 2:
For the purposes of this sub-section, a person shall be deemed to be of Indian origin if he, or either of his parents, was born in undivided India or in such other territory which became part of India after the 15th day of August, 1947.]

[(1A) The Central Government, if it is satisfied that special circumstances exist, may after recording the circumstances in writing, relax the period of twelve months, specified in clauses (f) and (g) and clause (i) of Explanation 1 of sub-section (1), up to a maximum of thirty days which may be in different breaks.]

Registration As A Citizen Of India Under Section 5(1)(A) Of The Citizenship Act, 1955 Made By A Person Of Indian Origin

Person of Indian origin who are ordinarily resident in India for seven years before making an application for registration.

Note: For the purpose of clause (a) an applicant shall be deemed to be ordinarily resident in India if-
  1. He has resided in India throughout the period of 12 months immediately before making an application for registration.
  2. He has resided in India during the 8 years immediately preceding the said period of 12 months for a period of not less than 6 years.
For the purpose of this subsection, a person shall be deemed to be of Indian origin if he, or either of his parents, was born in undivided India or in such other territory which became part of India after the 15th day of August, 1947.

The applicants are advised to carefully go through the provisions of the Citizenship Act, 1955 and rules framed there under to determine their eligibility for Indian citizenship.

  • A copy of valid Foreign Passport
  • A copy of valid Residential Permit/LTV
  • Evidence of the date of birth of the parents' viz. copy of the Indian passport, birth certificate, etc.

5. Use the Microsoft picture manager for resizing the image

Registration As A Citizen Of India Under Section 5(1)(f) Of The Citizenship Act, 1955 Made By A Person Of Indian Origin

A person of full age and capacity who, or either of his parents, was earlier citizen of Independent India, and has been residing in India for one year immediately before making an application for registration.

Note:
  1. Full age means 18 years of age and above.
  2. One year stay means continuous stay for a period of 1 year immediately before making an application for registration as a citizen of India.

The applicants are advised to carefully go through the provisions of the Citizenship Act, 1955, and the rules framed there to determine their eligibility for Indian citizenship.

  • A copy of a valid Foreign Passport
  • A copy of a valid Residential Permit/LTV

Process after submitting online form

Printout of online filled application Form has to be submitted in the office of District collector/ District Magistrate/Deputy Commissioner(herein after referred as district Collector) of the area where the applicant is ordinarily resident.

If the applicant is residing outside India, the printout of the application should be submitted to the Consular General of India.

Time to Acquire Citizenship

Rule 12. Forwarding of applications to Central Government

  1. The Collector shall forward every application received by him under clauses (a), (c), (d), (e), (f) and (g) of sub-section (1) of section 5 or sub-section (1) of section 6 to the State Government or the Union territory Administration, as the case may be, within a period of sixty days from the date of its receipt, along with a report as to whether the applicant- (a) satisfies all the conditions laid down in the relevant clauses of section 5 or section 6; (b) has an intention to make India his permanent home; (c) has signed the oath of allegiance as specified in the Second Schedule to the Citizenship Act, 1955; and (d) is of good character and is a fit and proper person to be registered or naturalised, as the case may be, as a citizen of India.
     
  2. The State Government or the Union territory Administration, as the case may be, shall forward the application along with its recommendation and the report of the Collector, to the Central Government within a period of thirty days from the date of receipt of the report of the Collector under subrule(1): Provided that if for sufficient reasons, the Collector or the State Government or the Union territory Administration, as the case may be, is unable to forward the application within the period specified in sub-rule (1) or sub-rule (2), the same may be forwarded to the State Government or the Union territory Administration or the Central Government, as the case may be, after the expiry of the period so specified but not exceeding ninety days along with the reasons for delay.
     
  3. All the applications pending with the Collector or the State Government or the Union Territory Administration, as the case may be, on the date of commencement of these rules shall be dealt with in the manner specified in sub-rules (1) and (2).
     
  4. If the application is not forwarded by the Collector or the State Government or the Union territory Administration, as the case may be, to the Central Government within a period of ninety days from the date of receipt of the application, the applicant may represent to the Central Government in the Ministry of Home Affairs by enclosing a copy of the acknowledgement issued by the Collector.
     
  5. The Central Government on receipt of the representation under subrule (4), may take up the matter with the State Government or the Union territory Administration, as the case may be, to expedite its recommendation on the application for grant of citizenship.
