In recent years the criminal law of the land have undergone radical changes to provide protection to women, more teeth have been provided to existing laws (DP Act, 498A, 406 IPC etc) and new enactments have been made (DV Act), but unfortunately the remedy is becoming worse than the ailment, which is now a well known fact as the stringent dowry laws have failed to stop the gruesome crimes for dowry/dowry deaths...

The number of cases being filed in the Supreme Court is consistently on the rise. 34683 cases were filed in Supreme Court in the year 1999, whereas, 70350 were filed in the year 2008, the increase being about 103% nine years. There are cases dealing with a broad spectrum of issues such as family matters and property which continue for generations. Such cases continue for atrocious periods of time, ranging from 7 years to 30 years. In such a scenario, the channelling of cases to different courts set up specially for this purpose not only ensures their speedy disposal, but also ensures that the cases, being dealt by with experts in courts specially set up for this purpose; are dealt with more effectively. The saying that “justice delayed is justice denied” then becomes relevant to take into consideration....

Since as per IPC homosexuality is treated as an act that entails criminal liability in India, how can a foreign homosexual couple be legally allowed to get a surrogate child? It is often alleged that Section 377 of IPC violates the fundamental rights of homosexuals in India. Despite the existence of literature drawn from Hindu, Buddhist, Muslim as well as modern fiction to testify the presence of same-sex affinity in various forms, homosexuality is still considered a taboo by both the civil society and the government in India...

Although there is little doubt that the adoption law is flawed, yet there exists some disparity about the proposed remedy. To some the law itself is welcome, but its content is not. They believe that adultery should be treated as a crime but the discrepancies should be amended. To the supporters of Madhav Mennon and the National Commission for Women the law is obsolete in the context of the modern society and does not merit being treated as a crime. On the other hand, the Malimath Committee on Criminal Justice Reforms recommends that adultery should remain as a crime but section 497 of the IPC has to be amended to the effect that it makes women also equally liable. In the light of these recommendations and observations of the Apex Court in various cases, it is high time that the law needs to be re-evaluated and we rid ourselves of the confusion...

Section 498A of the Indian Penal Code (IPC), which defines the offence of matrimonial cruelty, was inserted into the IPC by an amendment in 1983. Offenders are liable for imprisonment as well as a fine under the section and the offence is non bailable, non-compoundable and cognizable on a complaint made to the police officer by the victim or by designated relatives. Article 498 A passed by Indian Parliament in 1983, Indian Penal Code 498A, is a criminal law (not a civil law) which is defined as follows, "Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine. The offence is Cognizable, non-compoundable and non-bailable...
